San Clemente Teacher Accused of Orange County, California Sex Abuse

Richard Rack, a 50-year-old San Clemente math teacher, is accused of Orange County, California child sex abuse. He allegedly molested four female students.

The San Clemente injury allegations against him come following a several month probe by Orange County sheriff's detectives. Rack, a teacher at Shorecliffs Middle School, is accused of maintaining a sexual relationship with one of the teenagers for two years.

Related criminal charges against him over the sex abuse allegations include child annoyance or molestation (involving two of the victims), lewd acts upon a child (age 14 or 15), and suspicion of oral copulation of a minor. Rack was placed on leave by the Capistrano Unified School District in December.

One girl claimed that Rack kissed and hugged her and engaged in behavior with her that was inappropriate and sexual. Another girl contends that he got her to send him a naked photo.

"Sex abuse can lead to lasting damage for the victim, who may be left with major psychological and emotional scars," said Howard Law PC founder and San Clemente personal injury lawyer Vincent Howard. "State law can allow victims to hold their perpetrators and the parties that allowed the abuse or assault to happen under their watch liable in civil court."

It is unfortunate that child sex abuse involving teachers and students seems to occur more often than previously thought. At the same time, it is good news that this type of violent, violating behavior and the frequency with which it happens is starting to come to light. Hopefully schools will be more vigilant about who they hire as teachers, counselors, and coaches, while watching for signs of possibly inappropriate sexual behavior from their employees toward students or others under their supervision.

One of the more recent high profile child sex abuse cases that has been dominating the headlines is the criminal case against ex-Penn State assistant football coach Jerry Sandusky, 68,Last week, a a jury convicted him on 45 out of 48 sexual abuse counts involving 10 victims. Sandusky is expected to be sentenced to life in prison. He plans to appeal.

Many of Sandusky's victims were boys that he met through The Second Mile, which he established supposedly to help troubled youths. A number of the sex abuse incidents reportedly took place on Penn State grounds. The university is working to settle with the victims. Meantime, more criminal sex abuse charges, including those involving a son that he adopted who is now saying that Sandusky molested him, could be likely.

"Even if you were abused years ago, you still may be able to file a California child sex abuse lawsuit," said Orange County, CA injury lawyer Vincent Howard.

Victims of child sex abuse in California have to file their civil case within 8 years of the age of majority (prior to turning 26). That said, the state has adopted an extension to the statute limitations on the grounds of "discovery" of the sex abuse and its effects. A child sex abuse lawsuit can go forward b after the victim has turned 26 if it is within three years of when the plaintiff realized/found out or reasonably should have discovered that certain illnesses or injuries were a result of the child sex abuse. This extension period is essential because many victims may repress their memories for years.
