LAX Holiday Inn Workers Demand Millions of Back Wages in Wage and Hour Lawsuit
October 15, 2012
Costa Mesa-based labor and employment attorney Vincent Howard frequently reports on the topic of wage and hour violations and wage theft in the hospitality industry in Howard Law's California employment lawyers blog--where vulnerable workers in low wage industries, such as the hospitality industry, are often forced to endure violations of state and federal wage and hour laws.
In a recent Los Angeles, California wage and hour lawsuit, that Vincent Howard has been closely following, workers from a Holiday Inn at the Los Angeles International Airport (LAX) sued the hotel--accusing the Holiday Inn of cheating them out of millions of dollars in back wages.
According to the class action wage and hour lawsuit, filed by cooks, housekeepers, bartenders and other workers, the LAX hotel forced the employees to regularly work through their legally entitled meal and rest breaks, and were reportedly made to continue to work after clocking out. One worker claimed that after punching out, she was frequently required to go back and work for more hours, unpaid.
The employees also accuse their employer of falsifying their time records, to avoid having to pay the workers for overtime after they worked eight hours in a work day. The banquet workers also claim that they were denied the tips that they received, to which they were legally entitled.
The Los Angeles wage and hour lawsuit also claims that housekeepers were required to buy their own cleaning equipment like gloves, sponges, cleaning products and other supplies that were used to clean the guest room bathrooms--with no compensation.
Following the filing of the Los Angeles wage and hour lawsuit, the Holiday Inn workers also staged a one-day strike, to protest the firing of two workers who were reportedly outspoken about their labor and employment rights.
